Obama Birth Certificate Lawsuit:Philip Berg Lost – Obama birth certificate lawsuit filed by Philip Berg has been tossed out of court today.Philip Berg who was a Clinton supporter filed the lawsuit back in August saying that Obama’s birth certificate was a fraud and that his name should be removed from the ballot.Judge R. Barclay Surrick in Philadelphia ruled against Berg according to AP:
U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday. Obama and the Democratic National Committee had asked Surrick to dismiss Berg’s complaint in a court filing on Sept. 24.In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters. Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”

The birth certificate on the net is not the “vault” birth certificate – which shows the doctor, hospital, etc. etc
. From 1911 to 1972, in Hawaii a person over the age of one whose birth was not registered could apply for a birth certificate in Hawaii. Thus Obama’s mother could have filed an affidavit stating that Obama was born in Hawaii (possibly a home birth) and the state of Hawaii would have issued the kind of certificate posted on the internet. If Obama does’t produce the “vault” certificate (like the one millions of Americans have with the hospital etc. ) then, it leads to the conclusion that possibly he was born in Kenya… just as his Kenyan grandmother is saying,… He should produce the “vault” certificate and end this speculation

HONOLULU (AP) _ State officials say there’s no doubt Barack Obama was born in Hawaii.
Health Department Director Dr. Chiyome Fukino said Friday she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama’s original birth certificate.
Fukino says that no state official, including Republican Gov. Linda Lingle, ever instructed that Obama’s certificate be handled differently.
She says state law bars release of a certified birth certificate to anyone who does not have a tangible interest.

The director of Hawaii’s Department of Health confirmed on Friday what Barack Obama has been saying all along: the presidential candidate was born in Honolulu.
“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate,” said Chiyome Fukino. “State law prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.”
Citing her statutory authority to oversee and maintain Hawaii’s vital records, Fukino said she has “personally seen and verified that the Hawaii State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.
“No state official, including Gov. Linda Lingle, has ever instructed that this vital record be handled in a manner different from any other vital record in the possession of the State of Hawaii,” Fukino added.
Lingle, a Republican, has been campaigning on the Mainland for Obama’s opponent, Sen. John McCain of Arizona.
Obama, a Democratic senator from Illinois, was born Aug. 4, 1961, in Honolulu. He graduated high school at Punahou School in 1979.

These two versions of the same report seem clear enough. The birth certificate is on file in Hawaii and it is valid.
However, the opponents of Obama simply will not give up. I have seen one Web comment that went along these lines: “It could have been a valid Kenyan birth certificate on file in Hawaii that the Hawaii official was talking about.”
Laughable, of course, why would a Kenyan birth certificate be filed in Hawaii?

Sen. Barack Obama has been declared the winner of the race for president of the United States by several news organizations, and his Republican rival Sen. John McCain has given his concession speech at a rally in Arizona.
As of 11:45 p.m., it was projected that Obama had 338 electoral votes, well beyond the 270 needed. That makes him the first African-American to be elected to the White House.
As president-elect, Obama addressed a crowd estimated at about 100,000 people in Chicago at about midnight and said change is coming to America. Obama said he was going to be president of not just the “blue states” and “red states,” but of all of the United States of America during an acceptance speech that had many in the crowd with tears streaming down their faces.
In a concession speech in Arizona, McCain praised Obama’s successful campaign and called on Americans to work together to tackle the country’s issues.

All he has to do is prove it in the superior court. Why he hasn’t up to now is the reason for all of the doubt. You would think he would want Americans to trust and believe him. By NOT producing it he looks guilty of a cover up. By the way, bergs lawsuit was not lost because Obama provided evidence, It was dismissed because the judge said voters have no standing to ask. Not quite the same thing.

Who, other than you and some other bloggers have asked to see Obama’s original birth certificate?
If a court had asked for it, or the DNC had asked for it, or a state board of elections had asked for it, that would be a different thing.
Besides, why provide additional documents when (1) the certification of live birth is evidence that he was born in Hawaii and (2) there is no evidence that he was born anywhere else than Hawaii?

Yes, but there were about 10 cases in addition to Berg’s case, in different states, and Obama won them all. In most of the cases, it was because the courts ruled (as in the Berg case) that the plaintiffs had no standing to sue. But in some cases, the judge took a look at what was called “evidence” that Obama was not born in Hawaii, and found that the “evidence” was very weak.
In Ohio, for example the judge (magistrate) said:
“(Neal) presented no witnesses but himself. From that testimony, it is abundantly clear that the allegations in [Neal]’s complaint concerning “questions” about Senator Obama’s status as a “natural born citizen” are derived from Internet sources, the accuracy of which has not been demonstrated to either Defendant Brunner or this Magistrate … Given the paucity of evidence… this Magistrate cannot conclude that Defendant Brunner has abused her discretion in failing to launch an investigation into Senator Obama’s qualifications to hold the office of President of the United States. ” See:

Let’s go back to the statement you made: “by not producing it he looks guilty of cover up.” As I said, only the bloggers think that there is anything that Obama has to cover up. Only the bloggers think that Obama was born somewhere else than in Hawaii — but they have not proved it. So, Obama is not covering up anything. Nor does he appear to be covering up anything.
If a court asks to see the real document, and Obama does not provide it, then you could say that he was covering up. But that has not happened yet. And there is no proof that Obama was born anywhere else, so why should a court ask to see anything? If a court does ask for something, it must decide whether the certification of real birth is enough -and it might.
Prove that he was born somewhere else than Hawaii, and you can say that he is covering up something.
